Terms of Service

1. Acceptance of Terms

By scheduling an appointment, receiving services, or accessing our website, you ("Client" or "Patient") agree to be legally bound by these Terms of Service, our Privacy Policy, HIPAA Notice, and all other policies referenced herein. These terms constitute a binding agreement between you and Honey Rae Aesthetics ("Practice," "we," "us," or "our"). If you do not agree with any portion of these terms, you must discontinue use of our services immediately.

2. Medical Services and Scope of Practice

Honey Rae Aesthetics is a licensed medical aesthetic practice providing cosmetic and aesthetic medical treatments including, but not limited to:

  • Botulinum toxin injections (Jeuveau®, Dysport®, Xeomin®)
  • Dermal filler treatments (hyaluronic acid and other FDA-approved fillers)
  • Professional skincare treatments and chemical peels
  • Microneedling and radiofrequency treatments
  • Laser treatments and IPL therapy
  • Medical-grade skincare product sales
  • Aesthetic consultations and treatment planning

All treatments are performed by licensed healthcare professionals within their scope of practice. Services are for cosmetic enhancement purposes and are not intended to treat, cure, or prevent any disease or medical condition.

3. Client Eligibility and Requirements

Age Requirements:

  • Clients must be 18 years or older for most treatments
  • Clients aged 16-17 require parental consent and guardian presence
  • Certain treatments may have higher age requirements

Health Requirements:

  • Must provide complete and accurate medical history
  • Must disclose all medications, supplements, and allergies
  • Must not be pregnant or nursing (for applicable treatments)
  • Must be in general good health and suitable for treatment

4. Client Responsibilities and Obligations

Your active participation and honesty are essential for safe, effective treatment.

  • Medical Disclosure: Provide complete, accurate medical history including all prescription medications, over-the-counter supplements, medical conditions, previous aesthetic treatments, and allergies
  • Pre-Treatment Compliance: Follow all pre-treatment instructions including avoiding blood thinners, alcohol, and other specified substances when advised
  • Post-Treatment Care: Adhere strictly to all aftercare instructions to ensure optimal results and minimize complications
  • Appointment Punctuality: Arrive on time for scheduled appointments with completed intake forms
  • Communication: Immediately report any concerns, adverse reactions, or complications
  • Payment Compliance: Pay for services according to agreed payment terms and policies
  • Realistic Expectations: Understand that results vary and may require multiple treatments

5. Client Conduct & Safety

The safety and wellbeing of our staff and clients is non-negotiable.

Honey Rae Aesthetics maintains a zero-tolerance policy for harassment, discrimination, or abusive behavior directed at our staff, providers, or other clients. This includes but is not limited to:

  • Verbal abuse: Yelling, threatening language, demeaning or derogatory comments, or discriminatory remarks
  • Physical conduct: Any unwanted physical contact, intimidating gestures, or threatening behavior
  • Sexual harassment: Unwelcome sexual advances, inappropriate comments, or suggestive behavior toward any staff member
  • Digital harassment: Abusive or threatening messages via text, email, social media, or online reviews used as leverage

We reserve the right to immediately terminate any appointment, refuse future services, and permanently ban any individual who engages in such conduct. No refund will be issued for appointments terminated due to client misconduct. Incidents may be reported to law enforcement when appropriate.

6. Appointment Scheduling and Modifications

Scheduling: Appointments can be scheduled online, by phone, or in person. Confirmation is required within 24 hours of booking.

Changes and Cancellations: Must provide at least 24 hours advance notice. Late cancellations and no-shows are subject to fees as outlined in our Cancellation Policy.

Emergency Situations: Cancellation and no-show fees still apply. Honey Rae Aesthetics is not liable for any costs, expenses, or damages related to medical emergencies or any other circumstance.

7. Payment Terms and Financial Obligations

  • Payment Due: Payment is due in full at the time of service unless pre-arranged payment plans are established
  • Accepted Forms: Cash, credit cards, debit cards, and approved financing options
  • Package Purchases: Treatment packages must be used within specified timeframes and are non-transferable
  • Price Changes: Service prices may change with 30 days notice; existing packages honor original pricing
  • Outstanding Balances: Unpaid balances may be subject to additional collection efforts

8. Treatment Outcomes and Expectations

No treatment outcome can be guaranteed, and individual results may vary significantly.

Treatment outcomes depend on numerous factors including individual anatomy, skin condition, age, lifestyle, adherence to aftercare, and biological response to treatment. We make no guarantees regarding:

  • Specific aesthetic results or degree of improvement
  • Duration of treatment effects
  • Need for additional treatments or touch-ups
  • Complete elimination of targeted concerns
  • Prevention of future aging or skin changes

9. Risks, Complications, and Informed Consent

All medical aesthetic treatments carry inherent risks and potential complications. While serious complications are rare when treatments are performed by qualified professionals, they can occur. Common risks include but are not limited to:

  • Temporary swelling, bruising, redness, or tenderness
  • Infection at injection or treatment sites
  • Allergic reactions to products used
  • Asymmetry or uneven results
  • Need for corrective treatments
  • Rare but serious complications specific to each treatment type

Detailed treatment-specific risks will be discussed during consultation and documented in treatment-specific consent forms.

10. Limitation of Liability and Indemnification

Limitation of Liability: To the maximum extent permitted by law, Honey Rae Aesthetics' total liability for any claims arising from or related to services provided shall not exceed the total amount paid by the client for the specific treatment(s) in question.

Excluded Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost wages, emotional distress, or loss of enjoyment of life.

Client Indemnification: Client agrees to indemnify and hold harmless the Practice from any claims arising from client's failure to disclose medical information, failure to follow pre/post-treatment instructions, or misrepresentation of health status.

11. Intellectual Property and Confidentiality

Our website content, photography, and marketing materials are protected by copyright. "Honey Rae Aesthetics" and associated logos are trademarks of the practice. Client treatment records and personal information are kept strictly confidential under applicable state and federal privacy laws, including HIPAA where applicable.

12. Dispute Resolution

Governing Law: These Terms of Service and any disputes arising from or related to our services shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.

Informal Resolution: Before initiating any formal dispute resolution, you agree to contact us in writing at kendra@honeyraeaesthetics.com describing the dispute. Both parties will attempt to resolve the dispute informally within 30 days of written notice.

Binding Arbitration: If informal resolution fails, any remaining dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in Utah County, Utah. Each party shall bear its own attorney fees and costs; arbitrator fees shall be split equally unless the arbitrator determines otherwise.

Small Claims Exception: Either party may bring an individual action in small claims court in Utah County, Utah, if the claim falls within the court's jurisdictional limits.

Class Action Waiver: All disputes must be brought in an individual capacity. You agree to waive any right to participate in a class action, collective action, or representative proceeding.

Professional Malpractice Exclusion: Claims involving professional malpractice or medical negligence are excluded from the arbitration requirement and may be pursued through appropriate legal channels in the State of Utah.

Time Limitation: Any claim or dispute must be filed within one (1) year after the cause of action arises, or it is permanently barred, except where a longer period is required by applicable law.

13. Modifications and Updates

We reserve the right to modify these Terms of Service at any time. Significant changes will be communicated via email or posted notice. Continued use of our services after changes constitutes acceptance of the modified terms. Current terms are always available on our website.

Data Retention

We retain personal information collected through this website only for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations, and resolve disputes.

  • Contact form submissions: 2 years from date of submission
  • Assessment form submissions: 2 years from date of submission
  • Marketing consent records: Until you withdraw consent, plus 3 years for compliance documentation

SMS Communications & Consent

If you provide your phone number and opt in to receive text messages from Honey Rae Aesthetics, the following terms apply:

  • Message Types: Appointment reminders, booking confirmations, treatment follow-up messages, and occasional promotional offers (if you have opted in to marketing texts)
  • Frequency: Message frequency varies; appointment reminders are typically 1-2 messages per appointment. Marketing messages will not exceed 4 per month.
  • Opt-Out: Reply STOP to any text message to unsubscribe. You will receive a one-time confirmation message. You may also opt out by calling (801) 210-9268 or emailing kendra@honeyraeaesthetics.com.
  • Help: Reply HELP for assistance.
  • Costs: Message and data rates may apply. Honey Rae Aesthetics does not charge for text messages, but your wireless carrier may apply standard messaging fees.

Your consent to receive text messages is not a condition of purchasing any services. You may schedule appointments and receive services without opting in to text communications.

Interpretation and Definitions

Interpretation

The words which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Your medical records, treatment history, and appointment data are managed through Aesthetic Record, our HIPAA-compliant electronic medical records (EMR) and practice management platform. Aesthetic Record maintains its own privacy policy, terms of service, and security practices governing your health information stored in their system.

Important: This website does not store medical records, treatment history, or health information in its database. Our website collects only contact form submissions (name, email, phone, message) and general skin concern preferences from our online assessment tool.

Information submitted through our website contact and assessment forms is used solely to facilitate communication with our team and is not integrated into your medical record. Your official medical record is maintained exclusively within Aesthetic Record.

4. Your Rights Regarding Your PHI

Right to Access Your Records:

You have the right to inspect and obtain a copy of your PHI. Requests must be made in writing. We may charge a reasonable fee for copying costs. We will respond to your request within 30 days.

Right to Amend Your Records:

You may request that we amend your PHI if you believe it is incorrect or incomplete. Requests must be made in writing and include a reason supporting the request. We may deny your request if the PHI was not created by us or if it is accurate and complete.

Right to Request Restrictions:

You may request restrictions on how we use or disclose your PHI. We are not required to agree to your request unless you are requesting that we not disclose PHI to your health plan for payment purposes and you have paid for the service in full.

Right to Confidential Communications:

You may request that we communicate with you about your healthcare in a particular way or at a certain location. For example, you may request that we contact you only at home or only by mail.

Right to an Accounting of Disclosures:

You may request a list of disclosures of your PHI that we have made. This list will not include disclosures for treatment, payment, healthcare operations, or disclosures made directly to you.

Right to a Paper Copy:

You have the right to obtain a paper copy of this notice from us upon request, even if you have agreed to receive the notice electronically.

6. Uses and Disclosures Requiring Authorization

Marketing Communications: We must obtain your written authorization before using your PHI for marketing purposes, except for face-to-face communications or promotional gifts of nominal value.

Sale of PHI: We must obtain your authorization before we receive any payment for disclosing your PHI (with limited exceptions).

Psychotherapy Notes: If applicable, most uses and disclosures of psychotherapy notes require your authorization.

Photography/Video: Any use of clinical photographs or videos for marketing, publication, or educational purposes requires your written authorization.

7. Breach Notification

In the case of a breach of your unsecured PHI, we will notify you within 60 days of discovery of the breach. The notification will include a description of what happened, the types of information involved, steps we are taking to investigate and mitigate the breach, and contact information.

8. Changes to This Notice

Refund & Cancellation Policy

All procedures are considered final sales. Please review our refund and cancellation terms carefully before booking.

Refund Policy

NO REFUNDS after the service is provided. Absolutely no refunds. Under no circumstance do we offer a partial refund or additional complimentary care.

All aesthetic procedures are considered final sales and are non-refundable. Results may vary based on individual factors, and questions can be addressed by our experienced team. A follow-up appointment is always recommended.

Touch-Up Policy

We want you to love your results. For injectable treatments (neurotoxins and dermal fillers), we provide a touch-up appointment within 14 days of your original treatment if results are not as expected. Touch-ups are at the provider's clinical discretion and are intended to refine results, not provide additional full treatments.

Adverse Events & Complications

In the rare event of an adverse reaction or complication directly resulting from treatment provided at our practice, we will:

  • Provide a follow-up appointment
  • Administer corrective treatment when clinically appropriate (e.g., hyaluronidase for filler dissolution)
  • Refer to appropriate medical care if the complication is beyond our scope of practice

Complications arising from a client's failure to follow pre- or post-treatment instructions, failure to disclose medical history, or normal expected side effects (temporary swelling, bruising, redness) are not eligible for corrective treatment at no charge. Absolutely no refunds after the service is provided. Under no circumstance do we offer a partial refund or additional complimentary care.

Retail Products

All skincare product sales are final. Not refundable. Opened products cannot be returned due to hygiene and safety regulations. Gift cards are non-refundable — all sales final.

Cancellation / No-Show Policy

For consideration to our staff, we have a 24-hour cancellation / no-show policy.

Our cancellation / no-show fee is $50.

If you're unable to make it to your appointment, please contact us as soon as possible.

Late Arrivals

Clients arriving more than 15 minutes past their scheduled appointment time will be charged the $50 no-show fee and rescheduled.

Gift Cards & Promotional Credits

  • Non-refundable: Gift cards and promotional credits cannot be redeemed for cash (except for balances under $5 as required by Utah law)
  • No expiration: Gift cards do not expire, in compliance with Utah consumer protection law
  • No inactivity fees: No fees will be charged for non-use of gift cards
  • Non-transferable: Gift cards are for use by the named recipient or purchaser only
  • Promotional credits: Credits from promotions, referral programs, or service recovery are subject to any specific terms communicated at the time of issuance and may have expiration dates

1. Nature of Medical Aesthetic Treatments

The services provided at Honey Rae Aesthetics are medical procedures performed for cosmetic enhancement purposes. While these treatments are generally safe when performed by qualified professionals, they carry inherent risks and potential complications that must be understood before proceeding.

Not a Substitute for Medical Care: Our treatments are cosmetic enhancements and do not replace regular medical care or treatment of medical conditions by your physician.

2. Treatment Risks and Potential Complications

Common Risks (may occur in 1-20% of patients):

  • Injection sites: Temporary pain, swelling, redness, bruising, tenderness
  • Skin treatments: Redness, peeling, dryness, temporary pigmentation changes
  • All treatments: Asymmetry, incomplete correction, need for touch-up treatments
  • Allergic reactions: Mild skin irritation, rash, itching
  • Infection: Minor skin infection requiring antibiotic treatment

Serious Risks (rare, less than 1% of patients):

  • Vascular complications: Blood vessel occlusion, tissue necrosis, blindness
  • Severe allergic reactions: Anaphylaxis requiring emergency treatment
  • Granulomas: Inflammatory nodules requiring medical treatment
  • Nerve damage: Temporary or permanent nerve injury
  • Scarring: Permanent skin changes or scarring
  • Systemic effects: Spread of toxin beyond treatment area (neurotoxins)

Treatment-Specific Risks:

  • Botulinum Toxin: Muscle weakness, drooping eyelids, difficulty swallowing, speech changes
  • Dermal Fillers: Migration, nodule formation, dissolution requirement
  • Laser Treatments: Burns, hyperpigmentation, hypopigmentation, eye injury
  • Chemical Peels: Deep scarring, permanent pigmentation changes, delayed healing

3. Individual Variation and Results

No two patients respond identically to treatment. Results cannot be guaranteed.

  • Individual anatomy: Bone structure, muscle patterns, skin thickness
